Victoria’s long service leave laws under review

The Victorian government today announced the Long Service Leave Act 1992 (Vic) (Act) is under review. The government is seeking public input in its examination of whether the Act is ‘meeting the needs of the modern workplace’.

Options proposed in the Discussion Paper include:

  • Allowing employees to take long service leave in several periods;

  • Allowing accrued long service leave to be cashed out;

  • Allowing pro rata long service leave to be taken after seven years’ service;

  • Paying employees who go on long service the same as they would ordinarily receive if they were still at work;

  • Whether the Act can be made fairer with respect to employees who have taken family leave;

  • Clarifying the Act in relation to casual and seasonal employees; and

  • Recognising prior service when a business is sold.
